Terms of Service
EFFECTIVE 10 May 2026
These Terms of Service (“Terms”) govern your access to and use of the Provident Estate Services website at providentcayman.com, our member portal, and our iOS and Android mobile applications (collectively, the “Service”). By using the Service you agree to these Terms.
1. About us
Provident Estate Services Ltd. (“Provident”, “we”, “us”) is a private membership concierge for the seasonal residents of the Cayman Islands.
2. Membership and eligibility
Provident is offered by introduction and on a private, founding-membership basis. The Service is intended for adults (18 and over) who have been accepted into the membership through our application process. Provident reserves the right to decline any application at its sole discretion.
3. Your account
To use the member portal you will create an account, either with an email address and password or by signing in with a supported third-party provider such as Google or Apple. You are responsible for:
- Providing accurate, current, and complete information.
- Keeping your password confidential and your account secure.
- All activity that takes place under your account.
You agree to notify us promptly of any unauthorized use of your account.
4. Service description
Through the Service we collect details about your fleet and home, prepare a proposal for membership, and (after enrollment) maintain a private dashboard where you can view visit history, service requests, and concierge messages. The actual concierge work is performed by our staff and is governed by your separate written membership agreement.
The mobile application is distributed through the Apple App Store and Google Play. Your use of those platforms is also subject to their respective terms; nothing in these Terms is intended to override rights you may have under those store terms. The Apple App Store End User Licence Agreement is incorporated by reference where applicable.
5. Fees
Membership fees, scheduling, and the scope of physical concierge work are agreed separately with you in writing. The website itself is provided to active members at no additional charge.
6. Acceptable use
When using the Service, you agree not to:
- Use the Service for any unlawful purpose.
- Attempt to access another member’s account or data.
- Interfere with or disrupt the Service.
- Probe, scan, or test the vulnerability of any system.
- Reproduce, copy, or resell any portion of the Service without our prior written consent.
7. Intellectual property
All content, branding, and software in the Service — including the Provident wordmark, design, copy, photography, and codebase — are the property of Provident Estate Services Ltd. or its licensors and are protected by copyright and other intellectual-property laws. You may not use any of it without our prior written consent.
8. Third-party services
The Service uses third-party processors (including Supabase for hosting and authentication, Google for OAuth sign-in and Android push notifications, Apple for Sign in with Apple and iOS push notifications, Resend for email delivery, and Vercel for hosting and analytics). Their use of your data is governed by their own terms and policies; please review our Privacy Policy for details.
9. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
10. Limitation of liability
To the fullest extent permitted by law, Provident, its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service. Our total liability arising out of or relating to these Terms or the Service shall not exceed the membership fees you have paid in the twelve months preceding the claim.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice. You may close your account at any time from within the mobile application (Settings → Delete my account) or by contacting your concierge.
12. Governing law
These Terms are governed by the laws of the Cayman Islands. The courts of the Cayman Islands shall have exclusive jurisdiction over any dispute arising under or in connection with these Terms.
13. Changes
We may modify these Terms from time to time. The effective date above reflects the most recent version. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
